By subscribing to the services of Net2Asia ("Net2Asia"), you agree to the following terms and conditions with respect to your account ("Account"). Below are the terms and conditions for Net2Asia’s products and services. Please read them carefully.
I. Acknowledgment and Acceptance of Terms of Service
The Net2Aaia.net products and services, calling card, netcard, global call, netentertainment and netlearning, are owned by Net2Asia.net. They are provided to you ("User") under the terms and conditions of this Terms of Service and any amendments. Any operating rules or policies for any type of products or service may be published from time to time by Net2Asia.net. By completing the registration process and clicking the "I AGREE" button, you are agreeing to the terms and conditions set forth by Net2Asia.net.
II. User’s Registration Obligations
In consideration of use of the Net2Asia.net Services, User agrees:
- To provide true, accurate, current and complete information about User as prompted by the Member Registration form, and
- To maintain and update this information to keep it true, accurate, current and complete. If any information provided by User is untrue, inaccurate, not current or incomplete, Net2Asia.net has the right to terminate User's account and refuse any and all current or future use of the Net2Asia Service by user.
- To be solely responsible for any and all charges incurred by customer due to customer's use of a local access number.
- To be solely responsible for any and all charges incurred by customer due to customer's use of any wireless device including, but not limited to, a cellular phone.
- To be solely responsible for all billing transactions. Billing transactions encompass purchase transactions (purchases that are online recharge transactions which are made after sign-up). Customer can pay for such transactions via a credit card.
III. Privacy Policy
Net2Asia.net will not share any information you provide or any information about you with any third party for any reason unless absolutely required to do so by law:
- as required by law;
- to comply with legal process;
- is necessary to enforce this license;
- to respond to claims that the communicator violated the rights of third-parties; or
- to protect the rights or property of Net2Asia.net or others.
User acknowledges, understands and agrees that Net2Asia may in its sole discretion report User to any local, state or federal authority or agency if User violates any of the Terms&Conditions of Service.
User acknowledges, understands and agrees that Net2Asia may in its sole discretion cooperate with any affected third party by providing information and/or data in either a civil or criminal forum if User violates any of the Terms&Conditions of Service.
User acknowledges, understands and agrees that Net2Asia.net does not endorse the content of any User communications and Net2Asia.net is not responsible or liable for any unlawful, harassing, libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene, tortuous, or otherwise objectionable content, or content that infringes or may infringe upon the intellectual property or other rights of another.
IV. Member Conduct
User agrees to abide by all applicable local, state, national, and international laws and regulations in User's use of the Net2Asia.net products and services, and agrees not to interfere with the use and enjoyment of the Net2Asia.net services by any other user or users. User agrees to be solely responsible for the contents of User's transmissions through the Net2Asia services. User agrees:
- to not use the Net2Asia.net Services for illegal purposes;
- to not interfere with or disrupt any Net2Asia.net services or servers or network connected to the Net2Asia.net Services;
- to comply with all requirements, procedures, policies and regulations of networks connected to the Net2Asia.net Service;
- to comply with all applicable laws regarding the transmission of data exported from the United States. User agrees not to transmit through the Net2Asia.net services any unlawful, harassing libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind. User agrees not to transmit any material that violates the rights of another; not limited to the intellectual property rights of another;
- to not transmit any material that violates any applicable local, state, national, or international law or regulation;
- to not attempt to gain unauthorized access to other computer systems or networks connected to the Net2Asia.net Services;
- . to not impersonate or create a false identity of any person, including but not limited to, a Net2Asia.net official, forum leader, guide or host; and
- not transmit "junk mail," "spam", "chain letters", or unsolicited mass distribution of commercial messages.
V. No Resale Of Service
User agrees not to resell the Net2Asia.net services or use of or access to the Net2Asia.net service unless otherwise permitted by Net2Asia.net. Any person or entity that resells any products and services owned by Net2Asia.net without the permission of Net2Asia.net may be subject to civil and/or criminal penalty as prescribed by law.
VI. Termination
User agrees that Net2Asia.net may terminate User's password, account or use of the Net2Asia.net services if Net2Asia.net believes that User has violated or acted inconsistently with the letter or spirit of this license or that User has violated the rights of Net2Asia.net or other users or parties.
VII. Advertisers
User's correspondence with or participation in any promotion of advertisers found on the Net2Asia.net service, including payment and delivery of related goods and/or services, and any other terms, conditions, warranties or representations associated with such dealings are solely between User and such advertiser. User agrees not hold Net2Asia.net liable for any loss or damage of any kind incurred as the result of any such dealing with any advertisers or as the result of the presence of such advertisers on the Net2Asia.net Service.
VIII. Limitation Of Liability
User agrees that Net2Asia.net shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Net2Asia.net services or products or for cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through or from the Net2Asia.net services or resulting from unauthorized access to or alteration of User's transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangible, even if Net2Asia.net has been advised of the possibility of such damages. User further agrees that Net2Asia.net shall not be liable for any damages arising from interruption, suspension or termination of Net2Asia.net services, including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
IX. Expiration Policy
The Net2Asia.net product, calling card, will expire six (6) months after your first use. The NetCard or your online Account PIN will expire six (6) months from the date of your most recent Account charge (or recharge). You may, therefore, extend the expiration period by simply recharging your account prior to the expiration of this six (6) month period. Net2Asia.net has the sole discretion to determine whether to grant any other extension request. All extensions will be confirmed via e-mail. Net2Asia.net is not obligated to refund any remaining balance left in your Account as of the date it expires.
X. Refund Policy
ALL SALES ARE FINAL. Net2Asia.net products and services are non-refundable and have no cash value.
XI. Changes In The Terms
Net2Asia.net reserves the right to change the terms of service without any prior notification.
XII. General
Net2Asia.net and the relationship between User and Net2Asia.net shall be governed by the laws of the State of California without regard to its conflict of law provisions. User and Net2Asia.net agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California.
